29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes (a) BA. V, LLC at 11748 Oneida St. Thornton, CO 80233: On or before 7/20/19 the employer did not ensure that employees were protected from injury, in that framed walls were laid horizontally on the first floor before they were erected. The walls were placed over floor holes that led to the basement. This condition exposed employees to a fall of 9 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) BA. V, LLC at 11748 Oneida St. Thornton, CO 80233: On or before 7/20/19 the employer did not protect employees from injury in that employees were working on the partially framed and decked second story of a new two story home without utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 10 feet.
