OSH ACT of 1970 Section (5)(a)(1): : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that:     Crespac, Inc., 5032 Royal Atlanta Drive, Tucker, GA - On or about December 3, 2019 employees were exposed to struck by, crushing or caught in between hazards while operating the #10 Yale forklift, without a seatbelt. The seat belt was wrapped in tape onto the back of the forklift and/or damaged and had not been repaired. 29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:   Crespac, Inc., 5032 Royal Atlanta Drive, Tucker, GA -  On or about December 3, 2019, employees were required to operate the sit down forklifts hauling material into the shop area.  The employer did not ensure that daily inspections were performed on the forklifts before placing it in service to detect any deficiencies/defects, exposing employees to struck by hazards in the following:  a)Yale sit down forklift #10 - The back-up warning alarm system and lights were inoperable, tires were worn, and the seat belt was inoperable/taped/broken.  The employer did not remove defective forklifts from service.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    Crespac, Inc., 5032 Royal Atlanta Drive, Tucker, GA - In the production area, employees required to heat the dye of the extrusion machines with a torch, were exposed to molten plastic splash hazards of greater than 300 degrees F, when the plastic hit the concrete floor. The employer's PPE assessment did not include an assessment of the hazards of molten plastic splashes, to include, but not limited to,  face shields and chemical resistant clothing. The employer had not assessed each job task for PPE as required by the standard, on or about 06/26/19.
