29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): a) On or about July 19, 2019, and at times prior, the controlling employer, New Generation Construction, Inc., did not ensure subcontracted employees were provided with appropriate measures used to control and/or access hoisted loads of tools or other material, while those subcontracted employees were engaged in stone work on a scaffolding system. On July 18, 2019, while engaged in scaffolding work, a subcontracted employee was hand reaching for a hoist rope hanging from the far side of a non-swiveling pulley and fell through an improperly braced mid-rail, sustaining severe injury in an approximately 55 foot fall to the ground.

29 CFR 1926.452(c)(2): Frames and panels were not braced by cross, horizontal, or diagonal braces, or combination thereof, which secured vertical members together laterally. The cross braces were not of such length to automatically square and align vertical members so that the erected scaffold was always plumb, level, and square. All brace connections were not secured: a) On or about July 19, 2019, and at times prior, the controlling employer, New Generation Construction, Inc., did not ensure the scaffolding system mid and top rails were properly braced and secured so as to prevent subcontracted employee falls and subsequent injuries. On July 18, 2019, while engaged in scaffolding work, an employee was hand reaching for a hoist rope hanging from the far side of a non-swiveling pulley and fell through an improperly braced mid-rail, sustaining severe injury in an approximately 55 foot fall to the ground.
