29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  a) On July 22, 2019 the employer did not initiate or maintain a safety and health program that provides for frequent and regular inspection of the jobsite by a competent person, in that employees were exposed to struck by hazards while tapping the concrete formwork with a hammer next to an excavation wall without cave-in protection   b) On July 22, 2019 the employer did not initiate or maintain a safety and health program that provides for frequent and regular inspection of the jobsite by a competent person, in that employees were exposed to fall hazards while walking on top of the nine foot high formwork to direct the flow of concrete.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On July 22, 2019 employees were not trained in recognition and avoidance of unsafe condition and the regulations applicable to the work environment to control or eliminate hazards, in that an employee stood on top of nine feet tall concrete formwork and directed the flow of the concrete without any type of fall protection.  On July 22, 2019 employees were not trained in recognition and avoidance of unsafe conditions and the regulations applicable to the work environment to control or eliminate hazards, in that the employees were tapping the nine feet tall formwork next to an excavation wall that was higher than the formwork without any type of cave in protection.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On July 22, 2019 the employer did not ensure that employees were protected from falling while standing on top of concrete formwork directing the flow of concrete into the formwork at a height of nine feet.

On July 22, 2019 employees were tapping concrete formwork at the edge of an excavation wall that was vertical and that did not have the spoil pile located more than two feet away from the edge of the excavation wall.

On July 22, 2019 employees were exposed to struck-by and caught-in hazards, in that the employees were in an excavation, the walls were nine feet high and vertical, and the employees were tapping concrete formwork next to the excavation wall without any type of cave-in protection.

On July 22, 2019 the employer did not ensure that formwork was supported or braced so that it would capable of supporting without failure exposing employees to struck-by hazards, in that inadequate support was used and part of the formwork fell onto an employee.
