29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) On July 19, 2019, a driver/operator was driving a Polaris XP1000 Utility Terrain Vehicle (UTV), along with four riders/workers, downhill on an unpaved road. The driver lost control of the vehicle which caused it to roll-over and resulted in a fatality and injuries to the four workers. The employer did not instruct UTV drivers/operators in recognition and avoidance of site-specific unsafe conditions while operating the UTV prior allowing the drivers to operate the vehicles. 29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices:    a) On July 19, 2019, the employer did not check the UTVs at the beginning of each shift for safe operating conditions prior to the employees operating them.
