29 CFR 1910.28(b)(13)(i): When work was performed less than 6 feet (1.6 m) from the roof edge, the employer did not ensure each employee was protected from falling by a guardrail system, safety net system, travel restraint system, or personal fall arrest system: a. On or about July 17, 2019, employees required to perform HVAC maintenance on the roofs of Buildings B, C and J were not provided fall protection when working within six feet of the edge. Employees were thereby exposed to the hazards of falls over nine (9) feet.

29 CFR 1910.28(b)(13)(ii): When work was performed at least 6 feet (1.6 m) but less than 15 feet (4.6 m) from the roof edge, the employer did not ensure each employee is protected from falling by using a guardrail system, safety net system, travel restraint system, or personal fall arrest system. The employer may use a designated area when performing work that was both infrequent and temporary: a. On or about July 17, 2019, in the facility, employees required to perform HVAC maintenance on the roofs of Buildings B, C and J were not provided fall protection when working between 6 and 15 feet of the edge. Employees were thereby exposed to the hazards of falls over nine (9) feet.
