29 CFR 1910.30(b)(1): The employer did not train each employee on or before May 17, 2017 in the proper care, inspection, storage, and use of equipment covered by this subpart before an employee uses the equipment.  a) On or about July 19, 2019, the employer did not train each employee in the proper care, inspection, and the use of a wooden pallet on a forklift to lift employees in the air as required.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration: Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  a) On or about July 19, 2019, in the yard storage building at Builders FirstSource, LLC, the employer had not adequately ensured that a competent person properly inspected the sit-down forklift with a work platform basket attachment to ensure that the work platform basket met the fall protection requirements, was properly secured to the forklift while raising the work platform basket and moving the forklift with the employee in the work platform basket into position to perform removal of vertical and horizontal 2x4 wooden wall storage support beams.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.   a) On or about July 19, 2019, in a storage building at Builders FirstSource, LLC, the employer did not prevent employees from falling 10 or greater to a lower level as required by not identifying specific types of fall protection to be utilized.   An employee fell greater than 10' from a work platform basket being raised by a sit-down forklift.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  a) On or about July 19, 2019, in a storage building at Builders FirstSource, LLC, the guardrail system on the work platform basket was inadequate in that one side was entirely open sided.
