29 CFR 1910.178(i)(1): Concentration levels of carbon monoxide gas created by powered industrial truck operations shall not exceed the levels specified in 1910.1000. The 1910.1000 Table Z-1 8-hour Time Weighted Average permissible exposure limit for carbon monoxide is 50 ppm:    a) On July 5, 2019, an employee working in the Warehouse Area was exposed to 346% of the 8-hour Time Weighted Average Carbon Monoxide exposure limit while 2 Yale Forklifts were operating in the Warehouse Area. The employee was exposed to a Carbon Monoxide Time Weighted Average of 172.8 ppm over a 510 minute time period.

29 CFR 1910.1000(e): To achieve compliance with paragraphs (a) through (d) of this section, administrative or engineering controls must first be determined and implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or any other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and/or technical measures used for this purpose must be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with 1910.134:  a) On July 5, 2019, the employer did not ensure enough fresh air was provided to the Warehouse Area when forklift activity was being conducted to ensure the employee carbon monoxide exposures did not exceed the 8-hour Time Weighted Average exposure limit of 50 ppm.

29 CFR 1910.1200(h)(3)(iii): The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used:  a) On or about July 5, 2019, employees had not received specific training on methods to be utilized to ensure enough fresh air is introduced into areas where forklift activities are performed.
