29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   On or about July 24, 2019, at the jobsite, an employee was observed operating a powered industrial forklift truck without prior training or evaluation by the employer.  Employees were exposed to struck-by and crushed-by hazards.

29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph:   On or about  July 24, 2019, at the jobsite employees were observed working from a 4-tier scaffold, that was approximately twenty-seven (27) feet high with the height to width ratio of more than four to one (4:1), that was not restrained from tipping by guying, tying or bracing.  Employees were exposed to fall, struck-by, and caught-in hazards from a scaffold collapse.
