29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces shall not be used as a means of access:    a)  Northeast corner of Central & 45th, Ocean City, South side of house:  Employees climbed down the cross braces and end frames, from the approximate 33-35 foot level of the six frame high by approximately 16 foot long by approximately 5 foot wide fabricated frame scaffold, on or about 07/25/2019.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)    Northeast corner of Central & 45th, Ocean City, South side of house:  Employees without proper fall protection were working approximately 33-35 feet above ground level from a fabricated frame scaffold, 6 frames high by approximately 16 feet long by approximately 5 feet wide for the platform between the uprights and from the side bracket platform on the side of the scaffold facing the chimney approximately 16 feet long by 1 1/2 -2 feet wide, on or about 07/25/2019.     NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a)    Northeast corner of Central & 45th, Ocean City, South side of house:  Employee without any fall protection worked from the 4.25:12 pitch roof, approximately 33-35 feet above ground level while installing the brick façade for the exterior surface of the chimney, on or about 07/25/2019.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
