(b) Construction site - On or about July 23, 2019 the employer did not ensure that an employee was using a harness with an attached lanyard while riding in a JLG 400S Boom Lift serial no. 80636 that was elevated 28 feet 9 inches above the ground resulting in a fall hazard.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems: (a) Roof - On or about July 23, 2019 the employer did not ensure that an employee was provided with fall protection while working on the roof installing screws in the framing 20 feet 8 inches above the ground, resulting in a fall hazard.
