Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:      (a)    On or about July 11, 2019 for the employees exposed to vehicle struck-by hazards while working on a public roadway cleaning up a hazardous material spills on Highway 22 approximately 2.2 miles south of Manning, North Dakota.      Abatement Note: Among other methods one feasible and acceptable means of abatement would be to follow the industry recognized practices established in the Manual for Uniform Traffic Control Devices Parts (1,5, & 6) which specifically discusses the use and installation of advanced warning signs and lane tapering.
