29 CFR 1915.71(j)(1): Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above water, were not provided with a railing, which had a top rail whose upper surface was from 42 to 45 inches above the upper surface of the staging, platform, or runway and a midrail located halfway between the upper rail and the staging, platform, or runway:   a) Vessel 341 (Charlie T - Port of Saint Louis, MO (Wet Dock)): On or about July 16, 2019, the employer required employees to perform shipbuilding operations on scaffolding without guardrails; exposing employee(s) to fall hazards of approximately eleven (11) feet to the next level below.

29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2):  a) Vessel 341 (Charlie T - Port of Saint Louis, MO (Wet Dock)): On or about July 16, 2019, the employer required employees to perform shipbuilding operations at and near the edge of unguarded floor holes and openings; exposing employee(s) to fall hazards of approximately ten (10) feet to the next level below.
