29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which was 6 feet or more above a lower level was not protected by falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On 7/24/2019, employees of Mark Spooner were using a wooden pallet as working surface to access an elevated work area to screw in metal sheets into a commercial building located at 1267 Highway J, Wright City, MO. The fork attachments of the Gehl RS5-19 telescopic handler were approximately 13 feet above the lower level, exposing employees to falls to the ground below.

An employee was observed standing on a wooden pallet not firmly secured to the fork attachments of a Gehl RS5-19, Serial Number 800-06-3945. The employee standing on the pallet was approximately 13 feet above the lower level. The employer did not provide a safety platform secure to the fork attachments, exposing the employee to a fall hazard.

Employees were exposed to hazards such as but not limited to being struck by moving objects, crushed by, and fall hazards.
