29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:  A)     Garita Roofing, conducting work at 5481 Holiston Court, Galena, OH 43021: On or about July 24, 2019, the employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during job site operations.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  A)     Garita Roofing, conducting work at 5481 Holiston Court, Galena, OH 43021: On or about July 24, 2019, the employer did not ensure that employees were protected from head injury hazards by protective hard hats while working below employees who were conducting roofing activities above. Employees were exposed to potential impact injuries caused by falling materials and/or equipment.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  A)     Garita Roofing, conducting work at 5481 Holiston Court, Galena, OH 43021: On or about July 24, 2019, the employer did not ensure that employees were adequately trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while conducting roofing activities atop the two story residential structure. Employees were exposed to approximately 20 feet fall hazard from the roof of the structure to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   A)     Garita Roofing, conducting work at 5481 Holiston Court, Galena, OH 43021: On or about July 24, 2019, the employer did not ensure that employees were protected from fall hazards while conducting roofing activities atop the two story residential structure. Employees were exposed to approximately 20 feet fall hazard from the roof of the structure to the ground below.  Garita Roofing was previously cited for a violation of this Occupational Safety and Health Standard (1926.501(b)(13)), which was contained in OSHA Inspection # 1269251, Citation number 1, Item number 1, and was affirmed as a final order on October 23, 2017, with respect to a workplace located at 6308 Dietz Drive, Canal Winchester, OH 43110.
