At the worksite - On or about July 18, 2019, the employer did not ensure employees who operated pneumatic nail guns utilized eye protection, thus exposing the employee to struck-by hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a). At the worksite - On or about July 18, 2019, employees engaged in construction activities were required to work from hieghts greater than 6 feet. The employees installed roof rafters while working from the ceiling joists and from the top of a second floor wall, where the employer failed to ensure fall protection was utilized, thereby exposing employees to a fall hazard up to approximately 20.7 feet.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503(a)(2)(i) through (viii).  a). At the worksite - On or about July 18, 2019, the employer did not ensure employees that worked from the ceiling joists and from the top of a second floor wall were trained by a competent person on the fall protection requirements, thus exposing employees to a fall hazard up to approximately 20.7 feet.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge.  a). Inside the structure - On or about and times prior to July 18, 2019, employees engaged in construction activities were required to utilize stairways to access the next higher working surface. The employer failed to ensure the interior stairway was equipped with a handrail and a stairrail system, thus exposing employees to a trip and a fall hazard up to approximately 5.8 feet.
