OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards and crush hazards due to unsafe operation of industrial vehicles.  a) Facility - On or about 07/29/19 and at times prior thereto employees operated the Kubota Wheel Loader R420S S/N 10956 with forklift attachment, and were not restrained by use of the seatbelt.  b) Facility - On or about 07/29/19 and at times prior thereto employees operated the Kubota Wheel Loader R420S S/N 10956 with other workers riding on a pallet mounted on the fork attachment, and also riding on the sides of the vehicle.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Facility - On or about 07/29/19 and at times prior thereto employees handled chemicals including (but not limited to) Cornerstone Plus herbicide (Winfield Solutions, LLC), Astro insecticide (FMC), FarmWorks spray indicator (FarmWorks), Distance insect growth regulator (Valent Professional Products), Mound Destroyer fire ant shield (Spectracide), Kontos insecticide (Bayer), and OnyxPro insecticide (FMC). The employer did not develop, implement, and maintain a written Hazard Communication Program.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift:  a) Facility - On or about 07/29/19 and at times prior thereto employees handled chemicals including (but not limited to): Cornerstone Plus herbicide (Winfield Solutions, LLC), Astro insecticide (FMC), FarmWorks spray indicator (FarmWorks), Distance insect growth regulator (Valent Professional Products), Mound Destroyer fire ant shield (Spectracide), Kontos insecticide (Bayer) and OnyxPro insecticide (FMC). The employer collected Safety Data Sheets (SDSs) but maintained them in the Office and did not ensure that they were readily available to the workers.
