29 CFR 1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:    On 3/25/2019, an employee of John Beal Inc. was repairing roof shingles on a residential building located at 2101 Preston Woods Parkway, Lake Saint Louis, MO.  The employee working on the roof was using a ladder to access the roof which was not extended three feet beyond the landing or edge of the roof.

Changed to: 1926.20(f)(1) Personal protective equipment. Standards in this part requiring the employer to provide personal protective equipment (PPE), including respirators and other types of PPE, because of hazards to employees impose a separate compliance duty with respect to each employee covered by the requirement. The employer must provide PPE to each employee required to use the PPE, and each failure to provide PPE to an employee may be considered a separate violation.      29 CFR 1926.501(b)(13):  "Residential construction." Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:      On 3/25/2019, an employee of John Beal Inc. was working on the roof of a residential building located at 2101 Preston Woods Parkway, Lake Saint Louis, MO.  The Employee was replacing a section of shingles approximately 20 feet above a lower level.  Guardrail systems, a safety net system, or a personal fall arrest system was not utilized.  The employee was observed on the roof of the building without fall protection.    John Beal Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in case Secretary of Labor vs John Beal Inc.; OSHRC docket numbers 17-0808; 17-0809; 17-0810; 17-0812; 17-0814; 17-0816 and was affirmed as a final order on 9/10/2018.    John Beal Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1289350, citation number 1, item number 1 and was affirmed as a final order on 3/26/2018, with respect to a workplace located at 105  East First Street, O'Fallon, Illinois.

Standards in this part requiring training on hazards and related matters, such as standards requiring that employees receive training or that the employer train employees, provide training to employees, or institute or implement a training program, impose a separate compliance duty with respect to each employee covered by the requirement. The employer must train each affected employee in the manner required by the standard, and each failure to train an employee may be considered a separate violation.      29 CFR 1926.1053(b)(6):  An unsecured ladder was used on surfaces that were not stable and level:    On 3/25/2019, an employee of John Beal Inc. was repairing roof shingles on a residential building located at 2101 Preston Woods Parkway, Lake Saint Louis, MO.  The ladder used to access the roof was placed on a 4:12 pitch awning over the front porch and was not secured to prevent displacement.  The company employee was exposed to fall hazards in excess of 12 feet to the ground surface below.     John Beal Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(6), which was contained in Secretary of Labor vs John Beal Inc.; OSHRC docket numbers 17-0816, OSHA inspection number 1218834, citation number 1, item number 2 and was affirmed as a final order on 9/10/2018, with respect to a workplace at 300 North Charles Street, Belleville, Illinois.
