The Employee was replacing a section of shingles approximately 20 feet above a lower level.  Guardrail systems, a safety net system, or a personal fall arrest system was not utilized.  The employee was observed on the roof of the building without fall protection.    John Beal Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in case Secretary of Labor vs John Beal Inc.; OSHRC docket numbers 17-0808; 17-0809; 17-0810; 17-0812; 17-0814; 17-0816 and was affirmed as a final order on 9/10/2018.    John Beal Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1289350, citation number 1, item number 1 and was affirmed as a final order on 3/26/2018, with respect to a workplace located at 105  East First Street, O'Fallon, Illinois.
