29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  The employer is failing to protect employees from struck-by and crushing hazards. This was most recently documented on or about July 31, 2019 at the Youngers & Sons Manufacturing Company, Inc. located at 19223 K42 Highway Viola, Kansas. The employer failed to adequately develop written lockout/tagout procedures for employees to follow while servicing and maintaining the following pieces of equipment:  The Cincinnati Milacron Magnum, s/n 3145A0197-0009, Mori-Seiki MH50, s/n 866, Mori-Seiki SL25Y, s/n 104, and the Mori-Seiki SL25Y Long Bed, s/n 101.  The equipment specific lockout/tagout procedures did not include:  (A)  A specific statement of the intended use of the procedure  (B) A listing of all energy sources including but not limited to pneumatic, electrical, and gravity  (C) The specific location of all listed energy sources  (D) The specific devices to be used to de-energize each energy source including but not limited to locks and hasps and ball valve lockout devices etc.  (E) The specific procedures for the temporary removal or transfer of lockout/tagout devices for the purpose of testing or positioning  (F) The specific steps to test and verify the effectiveness of the energy control devices and energy control measures prior to beginning or re-engaging in work.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  The employer is failing to protect employees from struck-by and crushing hazards. This was most recently documented on or about July 31, 2019 at the Youngers & Sons Manufacturing Company, Inc. located at 19223 K42 Highway Viola, Kansas. The employer failed to conduct and document a periodic review of the energy control procedures to include but not limed to the energy control procedures for the Cincinnati Milacron Horizontal Milling Machine exposing employees to struck-by and crushing hazards while performing servicing and maintenance activities.

29 CFR 1910.147(f)(1)(ii): When lockout or tagout devices temporarily were removed from the energy isolating device and the machine or equipment was energized to test or position the machine, the employees were not removed from the machine or equipment area in accordance to the paragraph (e)(2):    The employer is failing to protect a contractor employee from struck-by and crushing hazards. This was most recently documented on or about July 31, 2019 at the Youngers & Sons Manufacturing Company, Inc. located at 19223 K42 Highway Viola, Kansas. The host employer failed to prevent a contractor employee from crawling into the Cincinnati Milacron Horizontal Milling Machine while the machine was energized and wood blocks and bottle jacks used to support the 3,500 lbs. spindle carrier housing were removed. The contractor employee was exposed to struck-by and crushing hazards.

29 CFR 1910.147(f)(2)(i): Whenever outside personnel were engaged in activities covered by the scope and application of this standard, the on-site employer and the outside employer did not inform each other of their respective lockout or tagout procedures:    The employer is failing to protect employees from struck-by and crushing hazards. This was most recently documented on or about July 31, 2019 at the Youngers & Sons Manufacturing Company, Inc. located at 19223 K42 Highway Viola, Kansas. The host employer failed to coordinate their energy control (LOTO) procedures with the contractor employer before engaging in the servicing and repair of the Cincinnati Milacron Horizontal Milling Machine exposing the contract employee to struck-by and crushing hazards.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates and markings were maintained in a legible condition:    The employer is failing to protect employees from the struck-by hazards. This was most recently documented on or about July 31, 2019 at the Youngers & Sons Manufacturing Company, Inc. facility located at 19223 K42 Highway Viola, Kansas. Employees engaged in material handing activities using the forklifts at the Automatic Lathe area and the Horizontal Machining area were exposed to stuck-by hazards in that the following markings were not legible:    a) The data plate, that identifies the various rated capacities of the Optimum 30 Nissan forklift at different load configurations, was not legibly marked.    b) The control lever for side shift that raises, lowers, and tilts the mast of the Optimum 30 Nissan forklift was not legibly marked to indicate the actions the levers performed.    c) The control lever that spreads and closers the fork of the Toyota forklift, serial number 61561, model number 8FGCO25 was not legibly marked to indicate the actions the lever performed.
