29 CFR 1910.269(a)(2)(ii)(C): Each qualified employee was not trained and competent in the minimum approach distances specified in 29 CFR 1910.269 corresponding to the voltages to which the qualified employee was exposed and the skills and techniques necessary to maintain those distances. On or about August 1, 2019 at BDG Trees, LLC employee(s) were not adequately trained in the minimum approach distances for performing work near a single phase 72 kilovolt power line. Employees were approximately thirty feet above ground performing tree trimming operations while utilizing uninsulated tools that spanned the gap between them and the power line.

29 CFR 1910.269(r)(1)(iii): Line-clearance tree trimmers did not maintain the minimum approach distances from energized conductors given in Table R-6, Table R-9, and Table R-10. On or about August 1, 2019 in the rear lot of 201 Neil Avenue, New Orleans, LA employee(s) were approximately thirty feet above ground performing tree trimming operations and approximately six feet from the conductor while utilizing uninsulated tools that spanned the gap between them and a 72 kilovolt overhead electrical power line. The employee was not wearing rubber insulated gloves.
