29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or before August 1, 2019, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program, thereby exposing employees to struck-by hazards.  b. On or before August 1, 2019, the employer failed to initiate and maintain a safety and health program such as but not limited to an electrical safety program, thereby exposing employees to 110 volt electrical hazards.  c. On or before August 1, 2019, the employer failed to initiate and maintain a safety and health program such as but not limited to a fall protection program, thereby exposing employees to 20 foot fall hazards.  d. 29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or before August 1, 2019, where employees used pneumatic nail guns to secure lumber in the framing process, the employees' eyes were not protected, thereby exposing employees to struck-by hazards.  b. On or before August 1, 2019, where employees used circular saws to cut lumber in the framing process, the employees' eyes were not protected, thereby exposing employees to struck-by hazards.

29 CFR 1926.405(g)(2)(iv): Strain relief. Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  a. On or before August 1, 2019, where employees used an extension cord to provide electrical power to circular saws, the strain relief clamp of the male plug was pulled away from the outer insulating jacket of the cord, exposing the employees to a 110 volt electrical contact hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or before August 1, 2019, where employees were framing and sheathing the roof of a 2 story apartment building, the employees were not protected from falls, thereby being exposed to a 20 foot fall hazard.  b. On or before August 1, 2019, where employees constructed walkways on the second story to access different areas of the building, the walkways were not effectively guarded, thereby exposing the employees to a 10 foot fall hazard.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  a. On or about August 1, 2019, where employees used an extension ladder to gain access to the second story of a two story apartment building, the rungs of the extension ladder were bent and the ladder was not marked and removed from service, thereby exposing employees to fall hazards.
