29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed a training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. A) Rodriguez Rodriguez Service LLC on or about August 2, 2019 at the address of 5424 Watkins Road, Saint Henry, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained prior to the performance of material handling activities at the controlling employer's worksite. The untrained forklift operator, elevated an uneven, unbalanced load (pallet) on the forks to a receiving platform from where he proceeded to unload, contributing to the employees 32 feet fall to the ground below.

Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.
