29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a.)     On or about August 5, 2019, the employer did not ensure each operator was evaluated on the powered industrial vehicle equipment, including but not limited to the Daewoo D35S forklift. Employees were exposed to struck by hazards while moving material around the South Shop and fall hazards while lifting employees on pallets.

29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person:     a.)     On or about August 5, 2019, the employer did not ensure scaffolds were designed by a qualified person. Employees are required to utilize the Daewoo 35S forklift and stand on a lifted pallet to perform maintenance activities such as cutting off hucks from the side of the rail cars and are exposed to falls of approximately 10 in that the pallet is not an approved platform for the forklift, is not chained to the mast, and has no guardrails.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a.)     On or about August 5, 2019, the employer did not ensure employees were protected from fall hazards while lifting employees standing on a pallet on the Daewoo D35S forklift. Employees are required to use the platform to perform maintenance activities such as cutting off hucks from the side of the rail cars and are exposed to falls of approximately 10 in that the pallet is not an approved platform for the forklift, is not chained to the mast, and has no guardrails.

On or about August 5, 2019, the employer did not ensure employees were protected while performing work while standing on top of rail cars. Employees are required to access the top of the CLSX rail cars to perform various activities such as changing out running boards and cleaning, and are exposed to falls of approximately 14 feet to the concrete below.
