29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: On or about 08/06/2019, Dierbergs Central Bakery, located at 3400A Hollenberg Drive, Bridgeton, MO, did not conduct a periodic inspection of their Energy Control (LO/TO) Program. There was various equipment with more than one energy source. One such was the Depositor-Goodway, on the cake line, which had electric and pneumatic energy sources.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about 08/06/2019, Dierbergs Central Bakery, located at 3400A Hollenberg Drive, Bridgeton, MO, had not established a Hazard Communication Program complete with all the required corresponding Safety Data Sheets (SDS). The employer did have Material Safety Data Sheets (MSDS) for various products/materials. The employer had not converted everything to Safety Data Sheets. There were such products as: 1) Flavorchem/Orchida which may cause eye, skin and respiratory disorders; 2) Austin A-1 Bleach which may cause eye, skin and pulmonary edema; and 3) Green Solution Industrial Cleaner which may cause eye, dermatitis and respiratory tract irritation.
