29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: a) At 1592 West Beach Blvd., Unit P Westside Cottages, Gulf Shores, Alabama: On or about August 8, 2019 and at times prior; the employer failed to ensure employees working from an aerial lift were using fall protection exposing his employees to a fall hazard of up to 23.5 feet to the ground below. THE GH LEVEL UP CONSTRUCTION, LLC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.453 (B)(2)(V) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1395177, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 25, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 1592 WEST BEACH BLVD, UNIT C WESTSIDE COTTAGES, GULF SHORES, ALABAMA.
