29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) South George Street and Country Club Road, York, PA - Employees working in a trench greater than 4 feet deep did not have access to a ladder or safe means of egress, to exit the trench, on or about August 1, 2019. No abatement certification or documentation required.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) South George Street and Country Club Road, York, PA - Employees entered a trench 5 to 6 feet deep where the competent person classified the trench as C soil, and benched in accordance with B soil. The competent person did not move employees when evidence showed the benching on the gas station side began to fall in, on or about August 1, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
