29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a) On August 7, 2019, Fluorecycle, Inc. did not ensure that a written respiratory protection program was established for those employees required to use respiratory protection, including 3M half face tight-fitting negative pressure respirators, when working at the bulb crushing station.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  a) On August 7, 2019, Fluorecycle, Inc. required that an employee use a 3M half face tight-fitting negative pressure respirator when working on the bulb crushing station.  The employee had facial hair that interfered with the seal between the facepiece and the face.     No abatement certification or documentation is required for this item.

29 CFR 1910.134(k)(1): The employer did not provide respirator training that would ensure each employee could demonstrate knowledge of items in section (i)-(vii):  a) On August 7, 2019, Fluorecycle, Inc. required its employees to use respiratory protection, including 3M half face tight-fitting negative pressure respirators, when working at the bulb crushing station, without ensuring that each employee demonstrated knowledge on why the respirator was necessary and how improper fit, usage, storage or maintenance can compromise the protective effect of the respirator. 29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):     a) On August 7, 2019, Fluorecycle, Inc. did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:    1) Requirement for labeling and other forms of warning;  2) Safety data sheet (SDS) availability;  3) Employee information and training;  4) A list of hazardous chemicals known to be present in the workplace;   5) Methods to inform employees of the hazards on non-routine tasks; and   6) Methods to provide other employer(s) access to safety data sheets; information on any precautionary measures and the labeling system used in the workplace.      Employees were exposed to chemicals including, but not limited to, mercury vapor and petroleum hydrocarbons, when working at the bulb crushing station.
