29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) At a worksite located at 4800 Rockhill Rd, Kansas City, MO: Employees were exposed to health hazards in that they may be harmed by the use of a respirator. This was demonstrated on or about August 5, 2019 when employees were exposed to respiratory hazards when employees were directed to use filtering facepiece respirators while dry cutting concrete and had not been medically evaluated before being permitted to use a respirator.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: At a worksite located at 4800 Rockhill Rd, Kansas City, MO: Employees were exposed to health hazards in the form . This was demonstrated on or about August 5, 2019 when employees were exposed to respiratory hazards when employees were directed to use filtering facepiece respirators while dry cutting concrete. Wet methods or dust/vacuum collection systems were not in use. Employees were exposed to respiratory hazards from the accumulation of dust when the vacuums systems or wet methods were not utilized during the course of the project.
