29 CFR 1910.22(d)(1): (1) Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition.    On or about August 8, 2019, the employers had not maintained the walkway between the Power Center and Retail Receiving area of their Menasha location in safe manner. Employees were exposed to slips, trips and falls from exposed rebar sections and cracked and shifting concrete.

29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked.  On or about August 8, 2019, the passageway between the Power Center and Retail Receiving section of the Kitz & Pfeil Ace Hardware location in Menasha, WI was not maintained in good repair and created tipping hazards and stuck-by hazards from falling loads.

29 CFR 1910.242(b): Compressed air used for cleaning. Compressed air shall not be used for cleaning purposes except where reduced to less than 30 p.s.i. and then only with effective chip guarding and personal protective equipment.    On or about August 8, 2019, employees of Kitz & Pfeil Ace Hardware were using a compressed airline to clean off equipment by the power center. The air wand was not equipped with an air relief valve and had a dead end pressure that measured over 100 p.s.i.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about August 27, 2019, Kitz & Pfeil Ace Hardware in Menasha, WI did not certify that each forklift operator had been retrained every three years as required by the standard.
