29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a)  Slowey Construction, Inc. at 21st Street and Douglas Avenue, Yankton, SD 57078:  On or about and at times prior to August 6, 2019, the employer did not ensure that employees conducting work in an excavation were protected from cave-in, in that the excavation was approximately 11 feet deep and lacked an adequate protective system such as sloping, benching, or shield system. This condition exposed employees to struck-by hazards associated with a trench wall collapse.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    (a)  Slowey Construction, Inc. at 21st Street and Douglas Avenue, Yankton, SD 57078:  On or about and at times prior to August 6, 2019, the employer did not ensure that employees were removed from an excavation with vertical and near vertical walls and no cave-in protection. This condition exposed employees to struck-by hazards due to cave-in and crushing hazards.

29 CFR 1926.652(d)(1): Materials and equipment used for protective systems were not free from damage or defects that might impair their proper function:    (a) Slowey Construction, Inc. at 21st Street and Douglas Avenue, Yankton, SD 57078:  On or about and at times prior to August 6, 2019, the employer did not ensure that the protective system (GME Trench Shield, Model # T812DW) that had been used on site and was damaged was evaluated to ensure its suitability for continued use. This condition exposed employees to stuck-by and crushing hazards in the event of a shield failure.

This condition exposed employees to struck-by hazards associated with excavated material from rolling or falling into the excavation.
