29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a) Clean Room Facility- On or about August 8, 2019, and at times prior, the employer had not conducted a personal protective equipment hazard assessment for employees using Peridox RTU to disinfectant the clean room facility. Eye protection was not appropriate, face protection was not provided, and the protective clothing provided was not appropriate for chemical usage.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: (a) Clean room facility- On or about August 8, 2019, and at times prior, the employer exposed employees to a health hazard in that appropriate eye protection was not provided to employees using Peridox RTU, an eye irritant, to disinfect the clean room facility. Employees were given swimming goggles for eye protection when the traditional ANSI approved googles purchased would not fit properly with the required respiratory protection. (b) Clean room facility- On or about August 8, 2019, and at times prior, the employer exposed employees to a health hazard in that face protection was not provided to employees using Peridox RTU, a skin irritant, to disinfect the clean room facility.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) Clean Room Facility- On or about August 8, 2019, and at times prior, the employer exposed employees to a respiratory hazard in that, the employer had not established or fully implemented a respiratory protection program for employees required to wear respiratory protection while using Peridox RTU to disinfect the clean room facility. There was no written respirator program, medical evaluations, fit-testing, or training.
