29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Worksite was located at 113 South Midland Avenue, Kearny, NJ 07032 Employees performing re-roofing work on a private residence were exposed to fall hazards as they were working on a flat roof on the side of the house that was approximately sixteen feet high from the ground with no guardrails or fall protection. Violation was observed on August 8, 2019. b) Worksite was located at 113 South Midland Avenue, Kearny, NJ 07032 Employees performing re-roofing work on a private residence were exposed to fall hazards as they were working on a flat roof on the rear of the house that was approximately eighteen feet high from the ground with no guardrails or fall protection. Violation was observed on August 8, 2019.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: a) Worksite was located at 113 South Midland Avenue, Kearny, NJ 07032 Employees were exposed to fall hazards of approximately nine feet from the rear roof elevation as they were using a Werner extension ladder with the spur plates extended on a wooden plank deck which was not a penetrable surface. Violation was observed on August 8, 2019.
