OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  Employees who worked in the companion animal health pick-module in the warehouse area were exposed to fall hazards that ranged from eight feet on the second level to sixteen feet on the third level at the open space areas in the racking near the vertical support columns.  The employer had placed pieces of plywood over the 22 inch by 86 inch open spaces.  While performing work on the second level of the pick module area, an employee stepped onto an unsecured piece of the plywood which dislodged.  The employee fell through the racking, eight feet to the ground below and sustained serious injuries.

Employees were exposed to the fall hazards at open pick locations where there we no pallets of product present, on or about August 9, 2019.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
