29 CFR 1910.28(b)(1)(i)(A): Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Guardrail system; a) On or about August 13, 2019 the employer did not ensure that employees performing work on top of the paint oven were protected from falls greater than 10 feet in that that the top front side of the oven had no guardrail system in place. b) On or about August 13, 2019 the employer did not ensure that employees performing work on top of the paint oven were protected from falls greater than 10 feet in that the area to the right of the ladder on the top backside of the oven had no guardrail system in place.

The employer must ensure guardrail systems meet the following requirements: Midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members are installed between the walking-working surface and the top edge of the guardrail system as follows when there is not a wall or parapet that is at least 21 inches (53 cm) high: a) On or about August 13, 2019 the employer did not ensure that that guardrail system in place on top of the back side of the oven had a midrail in that it only contained a top rail and toe board.

29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: a) On or about August 13, 2019 the employers hazard assessment was in adequate in that it did not include arm and hand protection to protect employees from receiving burns from contact with the burner box on top of the paint oven.
