On or about August 5, 2019, the employer did not ensure employees were protected from falling while performing work while standing on top of rail cars. Employees are required to access the top of the CLSX rail cars to perform various activities such as changing out running boards and cleaning, and are exposed to falls of approximately 14 feet to the concrete below.

29 CFR 1910.30(a)(1): Before any employee was exposed to a fall hazard, the employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. a.) On or about August 5, 2019, the employer did not ensure employees had been trained to, including but not limited to identify and minimize fall hazards, utilizing and maintaining fall protection devices, prior to performing work while standing on top of rail cars. Employees are required to access the top of the CLSX rail cars to perform various activities such as changing out running boards and cleaning, and are exposed to falls of approximately 14 feet to the concrete below.
