29 CFR 1926.451(g)(4): Guardrail systems installed to meet the requirements of this section did not comply with the provisions listed in subparagraphs (i) through (xv) of this paragraph. a. On or about August 14, 2019, at the above addressed jobsite, an employee performing new window frame installation from a skyjack scissor lift, approximately twelve (12) feet above the ground, was exposed to injuries from falls due to the top guardrail in the down position.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926..502(e). a. On or about August 14, 2019, at the above addressed jobsite, an employee performing new window frame installation from a sunbelt rentals aerial lift #618390, approximately eight (8) feet above the ground, was not wearing a full body harnesses, thereby exposing the employees to falls.
