29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: On or about June 27, 2019, during the installation of roofing material on a residential apartment complex located at 3100 Block Lincoln Way West, Massillon, Ohio 44647, the employer did not conduct frequent and regular inspections of the job site where employees were exposed to cave in hazards from working inside a trench with near vertical walls with a varying depth of 8.5 to 10.7 feet.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about June 27, 2019, at a job-site located at 3100 Block of Lincoln Way West, Massillon, Ohio 44647; the employer did not ensure adequate cave-in protection was used to protect an employee working inside a trench with near vertical side walls and a depth varying from approximately 8.5 to 10.7 feet. The trench was determined to have type "B" soil by the on-site foreman Marco Hernandez.
