29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:  (a) Rooster Painting LLC at 7201 Leetsdale Drive in Denver, CO 80224:  On or before August 13, 2019, the employer did not ensure that a fall protection system was in place for employees working greater than 10 feet above the ground on a ladder jack scaffolding system.  Employees were performing work on a ladder jack scaffold platform that was 15.5 feet high and a ladder jack scaffolding system that was 13.5 feet high without the use of fall protection system. This condition exposed employees to a fall of 15.5 feet and 13.5 feet.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):  (a) Rooster Painting LLC at 7201 Leetsdale Drive in Denver, CO 80224: On or before August 13, 2019 the employer did not provide fall protection training to address the fall hazards of the construction site.  Employees were working on ladder jack scaffolds greater than 10 feet off of the ground without adequate fall protection training.  This condition exposed employees to fall hazards due to lack of knowledge.   29 CFR 1926.503(a)(2)(i) through (viii) include the following items:   (i) The nature of fall hazards in the work area;  (ii) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  (iii) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  (iv) The role of each employee in the safety monitoring system when this system is used;   (v) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  (vi) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and  (vii) The role of employees in fall protection plans; and  (viii) The standards contained in this subpart.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  a) Rooster Painting LLC at 7201 Leetsdale Drive in Denver, CO 80224: On or before August 13, 2019, the employer did not ensure that employees were properly using a portable ladder for access to a ladder jack scaffold. The employees were using the portable ladder to access the ladder jack scaffold, however the ladder did not extend at least 3 feet above the walking surface of the ladder jack scaffold nor was the ladder secured to a rigid support. This condition exposed employees to fall hazards from approximately 13.5 feet.
