29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On and about August 14, 2019, employee performing roofing work had not been trained to recognize and avoid or correct hazards, such as falls from height and ladders, and fire or explosion from unsealed fuel cans, or trained to understand and follow the OSHA Standards that apply to their work.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On and about August 14, 2019, employees were exposed to falls while reroofing a two story, steep pitch house when the employer did not train each employee to recognize and avoid or correct fall hazards or to understand and follow the OSHA Standards that applied to their work.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  On August 14, 2019, employees were exposed to falls from ladders when the employer did not train each employee to properly select, inspect, and set up and use ladders.

29 CFR 1926.152(a)(1): Only approved containers and portable tanks shall be used for storage and handling of flammable and combustible liquids. Approved safety cans or Department of Transportation approved containers shall be used for the handling and use of flammable liquids in quantities of 5 gallons or less, except that this shall not apply to those flammable liquid materials which are highly viscid (extremely hard to pour), which may be used and handled in original shipping containers. For quantities of one gallon or less, the original container may be used, for storage, use and handling of flammable liquids.  On and about June 6, 2019, employees were exposed to fire and explosion hazards while riding to the jobsite in a van and while working near a 2 gallon plastic gas can that did not have a spout cap to prevent fumes from escaping.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   On and about August 14, 2019, employees were exposed to falls while reroofing a two story, steep pitch house in that:  A: No fall protection was set up for the employee working on the porch roof;  B: One employee was working on the roof without any fall protection;  C: Two employees were working on the roof without a lifeline;  D: Only three anchors were installed for more than 6 employees;  E: Deceleration devices on a lifeline in use was damaged;  F: The ladder used to access the roof was not in a location where each worker could reach it while connected to a personal fall arrest system.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder.   On August 14, 2019, employees were exposed to falls from ladders while accessing/egressing the porch roof when the ladder did not extend at least 3' above the eave edge.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  On August 14, 2019, employees were exposed to laceration and falls while handling and climbing an aluminum flexible ladder that had three damaged rungs.
