The employer is failing to ensure that the eyes and face of employees are protected from flying particles while working on a residential roof. This most recently occurred on August 14, 2019 on the jobsite located at 10223 Wright St., Omaha, NE 68124. The owner and 2 employees were observed using hand-held pneumatic nail guns to install shingles on an existing single-story house without any form of eye or face protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on August 14, 2019 on the jobsite located at 10223 Wright St., Omaha, NE 68124. The owner and 2 employees were observed installing shingles on an existing single-story house without any form fall protection. Height from the ground to the edge of the roof is approximately 8.5 feet and the roof has a 4 in 12 pitch. Alberto San Diego was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1110414, citation number 1, item number 1, and was affirmed as a final order on December 17, 2015 with respect to a workplace located at 6431 Chesterfield Court, Lincoln, NE 68510.
