29 CFR 1910.23(b)(8): Ladders are used only for the purposes for which they were designed.    The employer is failing to protect the employees from fall hazards due to the incorrect type of ladder being used to access the above break room area storage area.  A modified fiberglass ladder was found to be in use to access this storage area, and that the bracing side of the ladder had been removed, allowing ladder to be leaned and unsecured in nature.  This was most recently documented on August 14, 2019 at Fyre-Tec 701 Centennial Drive Wayne, NE 68787.

29 CFR 1910.23(b)(9): Ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury.  The employer is failing to protect the employees from fall hazards as the pre-use inspections of ladders is not being performed.  A 6 foot fiberglass Type 1A ladder in the shop area was found and no pre use inspection checklist was evidenced to have been completed.  A 12 foot A frame ladder was also documented as not being inspected and defects not identified in that structural components had been removed increasing the chance for fall hazards. This was most recently documented on August 14, 2019 at Fyre-Tec 701 Centennial Drive Wayne, NE 68787.

29 CFR 1910.1200(f)(6)(ii): Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.    The employer is failing to ensure secondary containers have GHS labels applied for those chemicals on the production floor.  Ingested by, inhaled, or contacted by are the hazards related to the cutting fluid in the fabrication evidenced in a 3 gallon plastic container, and GF Seal 320 NCS near the powder coat work cell was evidenced in secondary containers with either inadequate or no labeling to identify contents. 29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  The employer is failing to protect employees from the physical hazards of chemicals in employee work areas at new hire, and as chemicals are added otherwise.  Sodium Hydroxide, GX Cool 2195, and GF Seal 320 NCS are chemicals used by employees or found in the workplace that are not specifically trained to.
