29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about August 13, 2019, and at times prior thereto, at the establishment, the employer did not ensure that all employees who operated powered industrial trucks such as but not limited to (Hyster 99-515 Tugger, Type 0120855FB) were competent to operate them safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l), exposing employees to tip-over, struck-by and crushed-by hazards.

29 CFR 1910.178(l)(4)(i): Refresher training including an evaluation of the effectiveness of the training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. On or about August 13, 2019, and at times prior thereto, at the establishment, employees operating powered industrial trucks, such as but not limited to the (Hyster 99-515 Tugger, Type 0120855FB), were not provided with refresher training including an evaluation of the effectiveness of the training, as required by paragraph (l)(4)(ii) to ensure that operators have the knowledge and skills needed to operate the powered industrial truck safely, exposing employees to the hazards of ejection and being struck-by.
