29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. At a commercial worksite located at 10641 State Line Rd., Kansas City, MO: Employees were exposed to stuck-by and caught-in hazards. This was demonstrated when an employee was permitted to work inside an excavation without any means of protective systems, nor a safe means of egress. The employer failed to remove the employee from the hazardous area until the items were addressed.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): At a commercial worksite located at 10641 State Line Rd., Kansas City, MO: Employees were exposed to cave-in hazards. This was demonstrated on or about August 14, 2019 when an worker was working in a trench that was 5.7 feet in depth without the use of any protective systems. The employer failed to design a bench or sloped system that was in accordance to Option (2) - Determination of slopes and configurations using Appendices A and B. Maximum allowable slopes, and allowable configurations for sloping and benching systems, shall be determined in accordance with the conditions and requirements set forth in appendices A and B to this subpart.
