OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush/struck hazards:    a)  In the elevator interior there was not a interior gate/door to protect employees from being caught/struck by steel beams and the elevator shaft projections as the elevator was moving up and down.      Location: 304 Boerum Street, Brooklyn NY    On or about 8/2/2019      AMONG OTHER METHODS AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS:  Follow ANSI/ASME A17.3-2002 Safety Code for Existing Elevators, Section 3.4.2(a) which requires that elevator cars shall have a car door or gate provided at each entrance.        NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.28(b)(1)(i): Each employee on a walking/working surface having an unprotected side or edge which was four feet (1.2m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.        Location : 304 Boerum Street, Brooklyn NY     On or about 08/02/2019    a)  On the elevator hoistway door facing out to the sidewalk; the door interlock was bypassed, allowing the elevator to operate with the door open; employees were exposed to fall hazard to the sidewalk.      b)  On the hoistway door facing into the woodshop at the 2fl; the door was modified with a pull chain to allow the elevator door to be opened from the hallway whether or not the elevator car was at the floor landing or was moving or at another floor; employees were exposed to fall hazard.

Location: 304 Boerum Street, Brooklyn NY    On or about 8/2/2019      Follow ANSI A17.3-2002 Safety Code for Existing Elevators, Section 2.7.1b Hostway Door or Gate Locking Devices Interlocks Required for Freight Elevators; Hoistway doors or gates for freight elevators shall be equipped with hoistway-door interlocks except as covered by (c)         NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
