29 CFR 1926.1153(d)(2)(iii)(D): Where the most recent exposure monitoring indicates that employee exposures were above the PEL, the employer did not repeat such monitoring within three months of the most recent monitoring: On or about August 27th, 2019, and at times prior thereto, employees were conducting work tasks not listed on Table 1 for which the most recent respirable crystalline silica exposure monitoring indicated exposed employees above the PEL. The employer had not repeated such monitoring within three months of the initial overexposure, exposing employees to the hazard of inhaling silica dust.
