OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by hazards:    On or about August 16, 2019 an employee was the riding point on a railcar and the employer failed to provide a form of protection to the employee from objects placed near the tracks resulting in death when the employee came into contact with a parked truck.
