29 CFR 1910.269(l)(3)(iii): The employer did not ensure that no employee approached or took any conductive object closer to exposed energized parts than the employer's established minimum approach distance, unless provisions described in (l) (3) (iii) (A) - (C) were followed: a) 1390 NY Route 17A, Warwick, NY, on August 19, 2019, and at times prior, two lineman were tightening slacked guy wires near energized conductors within the minimum approach distance of 3 feet and 4 inches ; the guy wires contacted energized conductors electrocuting the lineman.

29 CFR 1910.269(q)(2)(i): The employer failed to use the tension-stringing method, barriers, or other equivalent measures when installing or removing conductors and cables lines that can contact energized power lines or equipment. a) 1390 NY Route 17A, Warwick, NY, on August 19, 2019, and at times prior, the employer was tightening two slacked guy wires that were close to energized conductors, when the guy wires contacted the energized conductor(s) electrocuting the lineman.
