29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents:  a)  At 2705 Jackson Street, Lot 102 The Reserve at Wyndham, Opelika, Alabama:  On or about August 21, 2019 and at times prior; the employer allowed his employees to operate pneumatic nail guns without eye protection while performing siding activities exposing his employees to struck-by hazards.   THE VICTOR TERRAZAS DBA VICTOR TERRAZAS WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.102(A)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1303091, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON MAY 14, 2018,  WITH RESPECT TO A WORKPLACE LOCATED AT 709 LORI LANE, LOT 272, OPELIKA,  ALABAMA.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  a)  At 2705 Jackson Street, Lot 102 The Reserve at Wyndham, Opelika, Alabama:  On or about August 21, 2019 and at times prior; the employer failed to provide a ladder for employees to use to access the scaffold platform exposing his employees to a fall hazard of 17 feet 2 inches to the ground below.  THE VICTOR TERRAZAS DBA VICTOR TERRAZAS WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(E)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1303091, CITATION NUMBER 1, ITEM NUMBER 2, GROUP A AND WAS AFFIRMED AS A FINAL ORDER ON MAY 14, 2018,  WITH RESPECT TO A WORKPLACE LOCATED AT 709 LORI LANE, LOT 272, OPELIKA,  ALABAMA.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a)  At 2705 Jackson Street, Lot 102 The Reserve at Wyndham, Opelika, Alabama:  On or about August 21, 2019 and at times prior; the employer allowed his employees to perform siding activities from a ladder jack scaffold without first ensuring his employees were trained on the hazards associated with scaffolds such as but not limited to inspecting and setting up scaffolds exposing his employees to a fall hazard of 17 feet 2 inches to the ground below.  THE VICTOR TERRAZAS DBA VICTOR TERRAZAS WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.454(A) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1303091, CITATION NUMBER 1, ITEM NUMBER 4, AND WAS AFFIRMED AS A FINAL ORDER ON MAY 14, 2018,  WITH RESPECT TO A WORKPLACE LOCATED AT 709 LORI LANE, LOT 272, OPELIKA,  ALABAMA.
