29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) on or about August 23, 2019 employees were using an aluminum 20 foot, extension ladder to gain access to the second story roof, however, the ladder was too short to extend 3 feet above the landing surface in accordance to the requirements of this standard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): The employer fails to assure effective protection against falls as required by the standard, as demonstrated on August 23, 2019, when employees are working on a residential two story roof at 19 Reamoor Drive, Palm Coast, FL 32164 without fall protection and are exposed to falls of approximately 17 feet to the ground below. Sky High Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)13, which was contained in OSHA inspection number 1271499, citation number 1, item number 1 and was affirmed as a final order on November 17, 2017, with respect to a workplace located at 3450 Beauclerc Road, Jacksonville, FL 32256.
