OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards:    Location: 9 South Hackensack Ave Kearny, NJ 07032 - Loading Dock 14    a) Employees engaged in warehousing activities are exposed to crushing hazards when operating forklifts without using the provided seat belt, or other means of restraint, to ensure they remain safely inside the operator's compartment in the event of sudden unexpected motion. The employer did not ensure that forklift operator restraint devices or seat belts were used by Ti Logistics (host employer) and Modern Staffing (temp agency) employees.     Condition noted on or about 8/23/19.

29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by a type of guardrail system:    Location: 9 South Hackensack Ave Kearny, NJ 07032- Loading Dock 14    a) Ti Logistic employees walking on the loading dock were exposed to fall hazards of 4 feet, 3 inches in that the employer failed to ensure that the unprotected edge of the dock was protected by a chain, guardrail system or other means of fall protection when loading dock was not occupied by a trailer.  Condition noted on or about 8/23/2019.

29 CFR 1910.136(a): The employer did not ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures:      Location:  9 South Hackensack Ave Kearny, NJ 07032- warehouse    a) Employees exposed to crushing injuries while handling forklift propane tanks without designated personal protective equipment to include protective footwear. Propane tank weights can vary from 23 pounds empty to 56 pounds full.  Violation observed on or about 09/11/2019 and 10/01/2019.    b) Employees exposed to crushing injuries while handling merchandise material on pallets without designated personal protective equipment to include protective footwear. Merchandise material can vary in weight with the average pallet weighing 400 pounds.  Violation observed on or about 09/11/2019 and 10/01/2019.
